1.     Introduction

Welcome to the GainKaro mobile application and website ("Platform"). The services on the Platform are operated by GK Innovations ("We", "Us", "Our" or "GainKaro"). By accessing or using any services offered by GainKaro (collectively, "Services"), you (the "User") agree to be bound by these Terms & Conditions ("Terms").

Please read these Terms carefully as they constitute a legally binding agreement between you and GainKaro. If you do not agree to any of the Terms, you must not access or use the Platform.

2.     General Terms

These Terms, including our Privacy Policy and other applicable policies, form the complete agreement between GainKaro and the User. They override any previous oral or written agreements. We may modify these Terms at any time. You are advised to review them periodically for updates. Continued use of the Platform implies your consent to any modifications.

3.     Services Offered

GainKaro facilitates:-

-          Mobile & DTH recharges via partner APIs.

-          Affiliate shopping through customized shareable links from various Retailers.

-          Curated streaming content (Stream Central) through third-party YouTube hyperlinks.

GainKaro is a facilitator and not involved in the sale, supply, or delivery of any goods or services by Retailers. All transactions are between you and the Retailers. GainKaro is not responsible for the quality, safety, legality, or merchantability of the Retailer's products or services.

4.     Membership & User Eligibility

To become a Member and use our Services:- You must be a natural person above 18 years.

- You must provide accurate and complete information during sign-up.

- You agree to receive communications via SMS, Email, WhatsApp, and Push Notifications. We reserve the right to suspend or terminate your account if false information is provided or if you violate these Terms.

5.     Bonus, Reference Commission & Recharge Discounts

By proper use of the affiliate links through the GainKaro Platform, Members can earn cashback from qualifying purchases made by them. These transactions must be:

- Tracked and confirmed by Retailers.

- Not returned, cancelled, or rejected.

If GainKaro does not receive a commission from the Retailer, no cashback shall be issued to the Member. Cashback may be used in Recharging Mobile / DTH on GainKaro platform or can be withdrawn via bank/UPI once a minimum threshold (currently Rs.10) is reached.

 

UPI Payment

Description:

Upon requesting for withdrawal, amount will be transferred to the Customer's bank account within 72 hours. Money requested will be transferred to ("Customer") bank account in full without any transfer charges.

Terms and Conditions:

Once requested, money will be transferred to your bank account within 5 minutes to 72 hours depending upon your bank.

Transfer requests may take longer in case of weekends and bank holidays.

Once a transfer request is made, it cannot be cancelled or reversed whatsoever.

Customer shall ensure that the UPI ID entered is correct to avoid transfer to any incorrect bank account.

Upon the receipt of payment from GainKaro, it shall be the responsibility of the Customer to manage such funds thereon.

Any payments of over 2 Lakh INR will be subject to TDS deduction as per the applicable laws of India.

Any query related to bank transfers made by GainKaro should only be raised with GainKaro by emailing on info@gainkaro.com or by the Service WhatsApp Number.

 

Bank Payment

Description:

Upon requesting for withdrawal, amount will be transferred to the Customer's bank account within 72 hours. Money requested will be transferred to ("Customer") bank account in full without any transfer charges.

Terms and Conditions:

Once requested, money will be transferred to your bank account within 5 minutes to 72 hours depending upon your bank.

Once a transfer request is made, it cannot be cancelled or reversed whatsoever.

Customer shall ensure that the bank details entered are correct to avoid transfer to any incorrect bank account.

Upon the receipt of payment from GainKaro, it shall be the responsibility of the Customer to manage such funds thereon.

Any payments of over 2 Lakh INR will be subject to TDS deduction as per the applicable laws of India.

Any query related to bank transfers made by GainKaro should only be raised with GainKaro by emailing on info@gainkaro.com or by the Service WhatsApp Number.

Members may also earn Recharge Discount on successful prepaid mobile and DTH recharges done through the Platform. The amount of discounts varies depending on the telecom/DTH operator and recharge value. All such discounts are subject to confirmation by the upstream recharge provider/API partner. If any recharge is unsuccessful, reversed, or disputed, the related discounts will be forfeited. At GainKaro, Recharges of your mobile/DTH payments are real time transactions and there will be no refund or exchange permitted. Please be alert that you are responsible for the mobile number, DTH account number and all charges that result from those recharges/services. GainKaro is not responsible for any recharge/service for an incorrect mobile number, DTH account number.

For cases, where a transaction has been successfully completed at GainKaro, and money has been charged to your UPI or bank account but a recharge has not been credited within 24 hours of your completion of the transaction for reasons like "invalid recharge denomination", "service provider unavailable" and/or any technical issues, submit your request with proper identical by creating a Ticket at our Support Desk. Please note that once the transaction recorded at our end as failure, money automatically gets added into your GainKaro Wallet. You can either utilize this amount by recharging again or can get the same refunded back to your bank account by creating a Ticket at our Support Desk.

Once we received your request, our respective team shall investigate the exact reason of system failure/ happened incident and will get back to you at the earliest. If you have opted to refund the money from your GainKaro Wallet, money will be refunded within 2-3 business working days as per company norms/bank policies.

We request you to mention the following details inside your created Ticket at our Support Desk:

Note: GainKaro liability is only restricted to provide you valid recharges/services /refund to the extent of payment received by us. We shall not be entitled for any other claim or consequential liability arising out due to a failed recharge on our system.

Referral Commission and Bonus Policy

GainKaro offers a Referral Commission and Bonus program to reward users for referring others to the platform. Under this program, a referrer may earn a percentage of their referred user’s first qualifying transaction and recharge activity profit, subject to continued valid membership and activity.

In addition, the referrer will be eligible for a Reference Bonus upon successful engagement by the referred user. Specifically, after the referred user completes their second successful recharge, the referrer will receive a bonus equal to ₹3 or 1.5% of the Basic Recharge Plan amount, whichever is lower.

Furthermore, GainKaro provides an Online Purchase Bonus as an additional incentive. For the first five successful cashback confirmations generated by each referred user, the referrer will earn 10% of the actual cashback amount or ₹5, whichever is lower, per transaction.

All referral rewards are subject to verification, eligibility criteria, and platform policies. Users must not misuse the referral system, including but not limited to creating multiple or fake accounts to gain benefits. Any such fraudulent or abusive activity will result in immediate and permanent suspension of the user’s account, along with forfeiture of any pending or earned rewards.

6.     Fair Use & Restrictions

The following activities are prohibited:

- Brand bidding or unauthorized paid advertising.

- Creating fake referrals or self-referrals.

- Posting defamatory or harmful content.

- Using fraudulent payment methods or personal information.

Violation may lead to termination, forfeiture of pending payments, and legal action.

7.     Intellectual Property

All Platform content, including text, images, logos, and designs, is protected by intellectual property laws and is either owned by GainKaro or its partners. Unauthorized copying, redistribution, or commercial use is strictly prohibited. By uploading content, users grant GainKaro a global, non-exclusive, royalty-free license to use, display, and distribute such content within the Platform.

8.     Privacy & Data Usage

GainKaro collects user data in accordance with its Privacy Policy. By using the Platform, you consent to the collection and use of your data for improving the Platform, offering services, and compliance with applicable laws.

9.     Disclaimers & Limitation of Liability

The Platform and Services are provided on an "as-is" basis. We make no warranties regarding uninterrupted access, accuracy, or availability. You agree that:

- GainKaro is not liable for any loss of revenue, data, or profits.

- Our liability in any dispute shall not exceed Rs.500.

- GainKaro is not responsible for Retailer or Recharge Provider performance or disputes.

10.   Indemnification

You agree to indemnify and hold harmless GainKaro and its affiliates from any claims or damages arising from your misuse of the Platform, violation of Terms, or infringement of third-party rights.

11.   Modifications & Availability

We reserve the right to change or discontinue any part of the Platform or Services at any time, including for maintenance or technical reasons. We will notify users of significant changes.

12.   Governing Law & Jurisdiction

These Terms are governed by Indian law. All disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, India.

14.   Entire Agreement

These Terms, along with the Privacy Policy and any supplementary conditions, represent the entire agreement between you and GainKaro.

15.   Severability

If any part of these Terms is held invalid, the remaining provisions shall remain in effect.

16.   Force Majeure

GainKaro shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, wars, pandemics, or government actions.

You agree to comply with all applicable laws while using the Platform and Services.
